The terms that govern our site and services.

These Terms of Service (“Terms”) govern your use of profitacuity.com and the services provided by Profit Acuity, LLC. By using our site or engaging our services, you agree to these Terms.

Our services

Profit Acuity provides performance-based digital marketing services, including visibility, lead-generation, and supporting infrastructure, scoped through the Precision Profit Plan.

Payment terms

  • Performance-based billing — most visibility and lead-generation services are billed on performance (per click delivered, per qualified call, or on achieved rankings).
  • Flat monthly fees — infrastructure components (website, CRM, review system, and related tools) are billed at a flat monthly rate.
  • Setup fees — some components carry one-time setup fees, disclosed in your Plan before you commit.

All fees, billing structures, and any setup costs are presented in your Precision Profit Plan before an engagement begins.

Client responsibilities

You agree to provide accurate information and timely access to accounts and assets reasonably needed to deliver the services. Flat-fee infrastructure may be paused or canceled with reasonable notice as described in your engagement.

Performance & reporting

We measure performance monthly against the projections in your Plan. Where performance-based services do not deliver, you do not pay for them. Projections are estimates, not guarantees of specific revenue outcomes.

Text messaging (SMS) terms

By providing your mobile number and checking the consent box on our website chat or on one of our intake forms, you agree to receive text messages from Profit Acuity, LLC, including messages sent using automated technology.

  • Program description: messages relate to your inquiry, scheduling, and your Precision Profit Plan, and, where you have opted in, marketing and promotional offers.
  • Message frequency: varies by conversation, and is typically no more than a few messages per week.
  • Cost: message and data rates may apply. We do not charge for these messages; your mobile carrier’s standard rates apply.
  • Opting out: reply STOP to any message to stop receiving texts. You will get one confirmation message and nothing after that.
  • Help: reply HELP to any message, email hello@profitacuity.com, or call 610-936-6839.
  • Carriers: mobile carriers are not liable for delayed or undelivered messages.
  • Consent: consent to receive marketing text messages is not a condition of any purchase.

Limitation of liability

To the maximum extent permitted by law, Profit Acuity is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the fees paid for the services giving rise to the claim.

Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles.

Changes to these Terms

We may update these Terms from time to time. Continued use of the site or services after changes take effect constitutes acceptance of the revised Terms.
